Please read these Terms of Service carefully before placing an order with Your Marine & Motor ("we", "us", "our"). By accessing our website or placing an order, you agree to be bound by these terms.

1. Our Products

Your Marine & Motor creates custom, made-to-order apparel featuring artwork based on photographs provided by you. Each product is unique and produced specifically for you following your approval of a digital design proof.

2. Placing an Order

By placing an order, you confirm that:

  • You are at least 18 years of age, or are placing the order with the consent of a parent or guardian
  • The photos you upload are owned by you or you have the right to use them for this purpose
  • The information you provide (including your delivery address) is accurate and complete

We reserve the right to refuse or cancel any order at our discretion, including if we are unable to fulfil it for any reason.

3. Pricing

All prices are listed in New Zealand Dollars (NZD) and include GST where applicable. We reserve the right to change our prices at any time. The price charged will be the price displayed at the time your order is placed.

4. Design Approval

Before printing, we will send you a digital proof of your custom artwork by email. Production will not begin until you provide written approval. You are entitled to up to two rounds of revisions at no additional cost. Once you approve the design, no further changes can be made.

5. Intellectual Property

The custom artwork created for you is for your personal use only. You may not reproduce, sell, or distribute the artwork commercially without our written permission. By uploading photos to us, you confirm you hold the rights to those images and grant us permission to use them solely for the purpose of creating your order.

6. Delivery

We will make every reasonable effort to deliver your order within the estimated timeframes stated in our Shipping Policy. We are not liable for delays caused by circumstances outside our control, including courier delays or extreme weather events.

7. Limitation of Liability

To the fullest extent permitted by New Zealand law, our liability to you in connection with any order is limited to the purchase price of that order. We are not liable for any indirect or consequential loss.

8. Consumer Rights

Nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986. These rights apply regardless of anything stated in these Terms.

9. Privacy

We collect and use your personal information in accordance with our Privacy Policy, available on our website.

10. Changes to These Terms

We may update these Terms of Service from time to time. The current version will always be available on our website. Continued use of our website after any changes constitutes your acceptance of the updated terms.

11. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
